Legal Issues

Whether the 20-year limitation period under 42 Pa.C.S. § 5529 begins from the original foreign judgment entry date or from the domesticated Pennsylvania judgment entry date; whether the Appellee complied with UEFJA documentation requirements; and whether a foreign judgment can obtain a "new birthday" through renewals in the originating state.

Decision by the Court

The Pennsylvania Superior Court affirmed the trial court's orders denying Appellant's petitions to strike and/or open the foreign judgments.

Reasons for the Decision

The court interpreted "entry of judgment" in § 5529(a) to mean the domesticated Pennsylvania judgment since foreign judgments cannot be executed in Pennsylvania prior to domestication. Pennsylvania's UEFJA includes no statute of limitations for domesticating foreign judgments. The substantial weight of authority from 15 states holds that filing a foreign judgment triggers a new limitations period from the domestication date.
