Rejection of Top Proponent for Failure to Disclose Conflict of Interest Upheld by Court of Appeals
The Court of Appeals of Puerto Rico upheld the Central Office for Recovery, Reconstruction and Resiliency’s rejection of the highest-rated proposal in an RFP for project management, technical and advisory services.
Although Hill International (Puerto Rico), Inc. received the highest score based on the RFP’s evaluation criteria, COR3 awarded the contract to the next highest rated proponent, Accenture P.R. LLC. According to COR3, Hill failed to disclose its subcontractor’s relationship with another public corporation, as well as the professional relationship that an ex-public official had with Hill.
The intermediate appellate court found that Hill’s rejection was reasonable and consistent with the terms of the RFP. The court also rejected Hill’s contention that Accenture failed to comply with the terms of the RFP, finding no evidence to that effect.
